North Dakota Title Processing Information

I'VE GOT THE TITLE IN FRONT OF ME, NOW WHERE DO I SIGN?

Release ownership by signing on line 4, part 1 (seller's and assignment and warranty of title) indicated by (signature of seller) section on the front of the title. 

If the owner has the title, have them sign off as the seller. Exchange the payment for the correctly signed documents and the vehicle keys. Make sure to check for any unsigned liens on the title and obtain a proper lien release, if applicable. 

I'm the registered owner but I can't find my title:

The registered owner of legal owner must complete SFN 2872 Application for Certificate of Title and Registration with the vehicle information. There must be a reason for the duplicate title stated in the application. The duplicate title will be mailed to the lien holder of record or the registered owner. If the Motor Vehicle records show a lien, the title must be mailed to the lien holder unless a SFN 2876 Release of Lien by Legal Owner is provided. 

In North Dakota it is very important to obtain a negotiable title or the paperwork to apply for a duplicate title as there is no prescribed method of selling a vehicle without one.

The owner of the vehicle is deceased:

In the case of no probate proceedings: You'll be required to sign an Affidavit for Transfer without Probate (Form Reg.5) and either the vehicle title or form CA Reg. 227, the the next of kin or surviving spouse must sign both the name of the deceased and their own name.  There is a restriction on Reg. 5 that it can only be used if 40 days have passed since the death and the estate is valued at less than $60,000.

 In the case of a probated estate: You will need a certified copy of the death certificate, certified copy of the probate papers from the court and a properly signed title by the appointed executor of the estate. 

The vehicle was abandoned on my property:
